Quiksilver Polarized Sunglasses

Plenty of sunglasses designers offer eyewear with squared lenses, but Quiksilver’s shades nail the right shape and feel with just enough curved wrap in the distortion-free shatter resistant polycarbonate lenses that you can transition from casual to sport and still spot what’s coming out of the corner of your eye.

Many of the Quiksilver styles come with additional interchangeable lenses and a protective rubber case that separates the pocket for storing the other lenses. All models come with a 100% UV sun protection guarantee.

Depending on the style you choose, the Grilamid nylon frame offers slightly transparent flair that sets Quiksilver far apart from cookie-cutter basic black frames. Quality nickel-silver Italian hinges keep everything together in a smart blend of fashion and functionality.

Stir up your flair for vintage fashion with these Quiksilver The Last Polarized Sunglasses. Unlike the real stuff in consignment stores (look under scratch-and-dent) The Last Polarized Sunglasses have clear and highly durable CR-39 shatter resistant lenses with eight-base wrap coverage. It’s a sermon worth considering:
Why pay more for overpriced sports sunglasses when Quiksilver’s Preacher Polarized Sunglasses give you the same So-Cal surf styling and distortion-free, shatter-resistant polarized lenses for at least $20 less than similar designs? Quiksilver used the same high-quality nickel-silver Italian hinges found on their expensive sunglasses, but lightened the load across the temples and nose with a flexible Grilamid nylon frame.

Three Short Love Poems

Filed under: Arts-and-Entertainment, Poetry — Randall Ulbricht @ 10:41 pm

Here is a compilation of three short love poems written by twelve-year-old Emily. The first is a short poem about how Emily loves her teachers. During the school year, her literature class was given an assignment to write a letter to a departing teacher. Emily asked if she could write a poem instead and was given permission.

The second poem was written for a hand made card that Emily made for her mother for Mother?s Day. Similarly, the third was written for a hand made card for her father for Father?s Day.

The Last Day
by: Emily

The saddest thing
It’s hard to say
Is seeing you on
Your last day.

I take it for granted,
Though I see you a lot,
Just how much you do
And your kind thought.

You helped me understand
Things I couldn’t before.
I can’t bear to watch you
Walk out of that door.

Though I’ll miss you,
I know indeed
You’ll do great out there
Planting new seeds.

‘What seeds’, you are asking
‘Why can’t I see?’
But you have already
Planted one in me.

It will grow and grow,
As I learn more and more.
Each day I’ll remember
What you taught me before.

I’m happy for you
To plant more seeds.
I know they will grow
Without any weeds.

There won’t be weeds.
Yes, of that I am sure.
For you have touched them.
Now they are pure.

The saddest thing,
It’s hard to say,
Is seeing you on
Your last day.

A Mother?s Day Poem
by: Emily

Mom, I love you.
That is true.
All the way
To infinity, too.

Now that I?m older
And wiser, too,
I realize just
How much you do.

Most of the time
I don?t look to see
How many things
You do for me.

For this I am sorry.
Next time I?ll try.
You are wonderful,
And I?m glad you?re mine.

(Emily really can put out what she feels in a love poem, even at age twelve. I hope you see this in time for your next Mother’s Day because it is probably how your child feels about you, whether spoken, written or acted.)

A Father’s Day Poem
By: Emily

This is for you,
Dear Daddy of mine
To let you know
I think you’re devine.

A bunch of years
Have flown by real fast
But do not worry,
I’ll always keep our past.

It’ll travel with me
Wherever I go.
I’ll remember the times we’ve had
So long ago.

Please don’t be sad,
Dear Daddy of mine
For there are more to come,
You will find.

I’ll always remember
Those things we did
Like snowmobiling
(When Mommy was hid).

Riding our bikes,
Hitting golf balls,
Getting up on skis,
Without a fall.

Driving the golf cart,
Nicktoons Racing,
Jumping on the trampoline,
And later your back aching.

No matter where we go
Or what we do,
In my heart always
There’s a place for you.

I hope this card helped
You to see
Just how much
I love you, Daddy!

(More telling than the exact words are the eyes of the daughter as she watches her father read the personally prepared poem. I feel that all children can write down their feelings. Some may not be able to put in poem format, but I see them as poems anyway as they are from the heart. This may be the best way for them to express themselves.

When you see some spare time for your child coming up, why not give some space, and provide pencil and paper. Ask your child to write about how he or she feels about birds, or snow, or the blue sky, or you, or whatever. My guess is that you will be surprised!)

What is Copywriting and Why Is It So Important to Your Business?

Filed under: Business, Marketing — Paul Speziale @ 10:03 pm

?There is no harder job in the world than copywriting, yet there is none more rewarding…both financially and emotionally. It truly is the world?s best kept secret job?

First of all, there is some confusion about copywriting…let me dispel the most common myth:

What Copywriting is NOT

?Copywriting? is not ?Copyrighting?. Copyrighting is the act of securing the copyright on a piece of work. A copyright is just the legal right to reproduce the work.

What Copywriting IS…

Wikipedia, the online encyclopedia defines copywriting or the act of writing copy as:

Copywriting is the process of writing the words that promote a person, business, opinion, or idea. It may be used as plain text, as a radio or television advertisement, or in a variety of other media. I agree with this definition, but copywriting goes much deeper than that…It is both a science and an art.

Where You Can Find Examples of Copy

It?s generally used in advertising and marketing and is primarily used to sell goods and services, but it is also is used to communicate with people. You can find it in all ads that you see everyday… That includes: the Internet, newspapers, magazines, billboards and radio…on the package of things you buy, on the back of your milk carton and even the bible! More on that later…

The Problem With Copywriting and Why Its So Important

The act of copywriting is the most mis-understood skill in any business, yet at the same time it?s the most important.

Here?s why: It?s really just words on a piece of paper.

It makes it even more mis-understood when a copywriter asks for thousands of dollars and it only took them a week to prepare it.

But,

When written correctly and sent to the right people, it has been known to turn a mediocre business into an industry giant very rapidly.

Your words, reproduced thousands of times, leverage your message to thousands of people…and it costs only fractions of a dollar per letter to distribute it.

A well crafted, persuasive letter is one of the most powerful forces in the world today.

You know, while the National Enquirer won?t even win the Nobel Prize in Literature, they write with simple language and very effectively target their audience…they have over 15 million readers after all. With all the complaints they get, no one has ever complained they write too clear.

Words on a piece of paper have been known to create wars (or prevent them), to sell millions of dollars in goods, to express emotions and so on…

I said earlier that copywriting was in the bible…St. Paul, the Catholic saint, used copywriting to communicate the word of God to other people. He spread the message without ever having to be there personally. He was one of the earliest copywriters.

The president?s speech writer is a copy writer…he or she has to be very careful about the words they use.

The Role of a Copywriter

The role of the Copywriter is to write copy. Simple.

To write copy, a copywriter must research their a) intended audience and b) their subject matter. Then they must put pen to paper and create a message that will communicate their subject matter to their intended audience.

The copywriter must also pay attention to how the copy a) Looks: if the copy looks too overwhelming, no one will read it. b) Flows: if the ideas and words in the copy connect together properly.

In the end, what does a copywriter produce? The length and type of copy can vary…they can produce letters 30 pages long or as short as one sentence (or a word or two).

Writing 30 pages is definitely a skill, where if you want to sell something, it has to be extremely interesting so that someone will read it…

And writing a sentence? Sometimes that can take months of digging into volume after volume of dry product data and material to uncover the one phrase that can best describe the product.

Every word counts and is worth its weight in gold

In both cases, every word counts…the copywriter must agonize over every word because not only are you paying for the space you use (in a magazine for example) to distribute the copy, but the very words themselves can either persuade your audience to listen to you and buy your products…or completely turn them off.

Because of the complexities and the needs for copywriters…there has emerged a wide range of copywriters…they range from artists and English majors to people in sales.

The difference between the two, I will discuss in my next article: ?The difference between your ?everyday copy? and ?copy that sells?

Conclusion

Copywriting has been around for hundreds of years in various forms. Only in the last 100 or so has it been used so widely to sell goods and services. Yet, despite all this, it still remains one of the most mis-understood , but important aspects of any business. Everyone should know the basics of it and use that skill in their business.

How To Achieve Success

Filed under: Self-Improvement, Success — Arindam Chakraborty @ 8:19 pm

First of all, learn how to master your area of expertise. But books and course and start finding people that will help you achieve your goals.

Now analyze each part of the skill you wish to master. First draw a theoretical analysis, then a practical one. Practice relentlessly. Unless you practice you can’t achieve your goals. To get the maximum benefit out of practice,. you should set a regulator schedule when you can practice your skill. This is important because if there is a long gap between two practice schedules then you will lose momentum and it will not work. So prepare a timetable for yourself and start practicing. And most importantly, NEVER GIVE UP! Imagine that you have become a successful person say, at the end of this decade. Imagination is vital to achieve your goals and self-discipline also comes through imagination. Create a burning desire within yourself to succeed.

All those ‘gurus’ whom you see now weren’t the results of a ‘get-rich-quick’ scheme. They didn’t become rich overnight. Ask them and you will know that all of them had a burning desire to succeed and a appearance to achieve success. If you ant to succeed you should ingrain these qualities within yourself. Create self-confidence in yourself. Believe in yourself. Say that you have done some of the most wonderful things in the past. Re-live those memories and build a self-confidence within yourself and say to yourself ‘Yes, I too can succeed’. When you believe that you can do something you will see that you have found ways to achieve that success. Be methodical. By this I don’t mean that you need to be a techno. What I mean is that you should conceive a clear-cut method to achieve your goals, or you will never achieve them. There is no one method to achieve a goal and also not all methods work for everybody can show you some examples of persons who have achieved success but you will be surprised to know that each person followed a totally unique method to achieve his/her success.

But Beware! Learn from them, don’t COPY them. That will take you nowhere. Learn from the gurus and see how they have achieved success. Split test and analyze each method and see which one will fit you. Then use that method. Remember, gurus can teach you and give you suggestions, but they can’t give you a cheat sheet for success. Because you have to do that for yourself Lastly do away with your fears. Never let fears come in the way of your success. What’s it that you are afraid of? What is it that is preventing you from achieving success? Once you confront your fears you will become much easier for you to make clear-cut goals and try out new methods and strategies.Enjoy!

Canine Acne - What is It and How Do We Treat It?

Filed under: Dogs, Pets — David Brooks @ 7:36 pm

Everyone knows of acne as a human condition suffered by unfortunate teenagers during adolescence, but it is in fact quite common in certain breeds of dog too. The most susceptible breeds are young adult boxers, English bulldogs, Doberman pinschers, Great Danes and Rottweilers. The condition starts at puberty around 5 to 8 months of age. Most dogs improve with age and the condition typically resolves after one year of age, though some dogs can develop chronic acne.

Dogs with canine acne develop multiple comedones (blackheads) on their chin, lips, and muzzle. Plugs of debris made of natural substances such as keratin and sebum block the hair follicles, causing focal swellings which can rupture to form scabs.

Dogs with this condition have swellings, scabs and blackheads on their lips, chin and muzzle. These usually do not bother the dog unless a secondary bacterial skin infection develops. This can cause pain and itching, leading the dog to scratch at his/her face or rub it along the carpet.

Diagnosis is usually straight forward ? the characteristic appearance described above, in one of the known susceptible breeds is usually sufficient. Your vet may decide to take a skin biopsy for confirmation, which can be done under sedation, local or general anaesthetic and then sent off to a histopathologist for analysis.

Treatment

Canine acne cannot really be cured, but can be controlled. Mild cases are usually not treated. The first step is always to rule out other conditions such as demodecosis (a mite infestation), ringworm and puppy strangles. The latter also causes anorexia and depression so if your dog is bright with a good appetite, it is unlikely to be this. Also important is to uncover any predisposing factors such as underlying allergies. Some of the breeds mentioned above, such as Boxers, are particularly susceptible to food allergy. Regular cleaning with anti-acne products (eg benzoyl peroxide) or mild anti-seborrheic shampoos will be required to decrease the bacterial load of the skin and remove cellular debris which could contribute to blocking the pores.

If pustules have ruptured and a secondary bacterial infection develops, your dog will need to take antibiotics for 3 or 4 weeks. Most broad spectrum antibiotics are effective, but to avoid any resistance problems a bacteriology swab is advisable so that a suitable antibiotic can be chosen with certain efficacy against the bacterium in question.

If a dog is scratching at his/her face a lot, an anti-inflammatory drug such as a one off steroid injection is probably indicated to alleviate the discomfort.

Refractory and recurrent cases can sometimes respond to retinoid therapy ? similar to the human drug Roaccutane, which essentially stops the sebaceous glands in the skin from producing sebum. This however requires a veterinary specialists consent.

How to Turn Everyday Clay into Ceramics

Step 1: Choosing your clay - you may prepare raw dug up clay or much preferred material for consistency purchase commercial clay.

Taking into consideration the temperature needed to turn clay into ceramics by way of a kiln, it is important to know the minerals that are present within the clay paste. (You can either use a beginner’s chemistry set or preferably refer to your local yellow pages for experts in this field.) Keep in mind, certain materials need very high temperatures to turn. Please read information on firing temperatures for commercially prepared clays below for an idea of choosing the right temperature to turn your freshly prepared clay into ceramic.

- If you prefer to dig up and prepare your own clay, you can follow the guidelines below for best product:

a) Freshly dug up clay will have impurities such as plant material, stones, insects, even air pockets. Let your clay air dry before breaking it up for cleaning.

b) Next, make sure the dried clay is in small pebble like pieces. Use a hammer, mortar for grounding these pieces into powder. To get the right consistency for the next step, make sure to weight your powders in a plastic bag and set aside.

c) Third, Get a bowl, pure the powdered clay in bowl and slowly pour water to form a paste. Use a wooden spatula to knead. If the powder floats or does not seem to mix with the water, let it set for a while before kneading again. Remember it must form a thick paste. If it does not, possibly too much water was added or not enough powdered clay.

d) Fourth, the cleaning process is about to begin. Press your clay paste through the your 80-mesh sieve to remove all impurities.

e) Place your cleaned clay onto to a plaster bat and smooth. The clay will begin to harden, you will need to move the paste around frequently to prevent hardening.

f) Using a strong flat stick remove the stiff clay from the plaster bat by peeling it off. Now you can knead your clay for modeling and firing.

- If you prefer to purchase your clay it will come in the following form to choose from:

a) Earthenware - red or white (kiln fires from 1830 to 2160 degrees Farenheit);

b) Stoneware - beige to white (kiln fires from 2190 to 2370 degrees Farenheit);

c) Porcelain - white (kiln fires from 2340 to 2460 degrees Farenheit);

d) Grogged stoneware - slate (kiln fires from 2190 to 2340 degrees Farenheit);

e) Raku body - slate (kiln fires from 1830 to 2340 degrees Farenheit); or

f) T Material - cream color (kiln fires from 1830 to 2370 degrees Farenheit);

Unfired clay is quite flexible. By kneading and handling it you can determine what that lump of clay is best suited in making. Look for shrinkage rate, and strength to determine durability.

Primary clay is extremely pure however it is not very pliable.

As an FYI, there are about 6 types of clay:

Red clay - very common to find. Its high iron oxide mineral content gives the clay its rich red color as well as makes it very easy to use.

Fire clay - can be fired to extremely high temperatures. Has a beige to medium brown color when fired. Usually found near coal seams.

China clay - used as glaze with other clay products. It is considered as primary clay meaning that it has minimal pliability.

Ball clay - extremely flexible, but breaks easy. It has to be combined with other types of clay to maintain its strength, shape and durability. Commonly used for porcelain and decorations.

Bentonite -Small amounts are combined with primary clay such as China clay to make it more pliable for molding.

Stoneware clay - Rare. This is high mixed mineral content which when fired turns gray to white.

Step 2: Your clay is not ready for kneading. (This includes both freshly dug clay that has been cleaned and commercially bought clay.)

a) Place your clay on an absorbent firm surface for kneading and throwing the pockets of air out. Take a wire and cut clay in easily handy wedges. Pick up 1 piece of clay at a time, with cut edge facing you, heartily throw or slam clay on bench to remove pockets of air. (It is extremely important that no air pockets are present in the clay so as to prevent explosions, or other mishaps that can occur if clay is firing in kilm.) Continue to knead, slam and pivot clay until all sides of clay are thoroughly kneaded. Repeat about 10 times or more to be sure. As a check at the end of kneading, use your wire and cut the clay in half. Take a look to make sure the surface is completely smooth. It should not have bumps, lumps, or wholes. It should be absolutely smooth.

b) Use a damp sponge and wet your pottery wheel lightly so that your clay will adhere but not slip.

c) Next, slam a ball in the center of the wheel. With both hands lightly on clay use forward and backward motions to see if clay is sticking to the wheel. If the clay is slipping or sloshy, wipe moisture off wheel. Turn wheel on or begin kicking wheel. Place both hands steadily on either side of clay and begin pushing inward slightly and upward. The clay will resemble a cone.

d) At the top of the cone, use your thumb to flatten and eventually use one hand;makes sure the other hand supports the sides of the clay. While the wheel is turning, use 3 fingers with the flat hand at the top middle of the cone to form a pocket. Remember to keep supporting the sides. You will see a bowl forming. Now both your creative hand on top or by now in the middle of the bowl and on the side hand are working in unity. How you wish your bowl to appear is part of the creative process.

When done, use wire to remove clay bowl from wheel and place on drying rack. When bowl is completely dry it is now ready for the kiln.

Web Site Promotion: Timeless Candles’ Secret Weapon

The first thing that any semi savvy entrepreneur must do before starting a business is take a look at the competition. A physical business, like a neighborhood restaurants, may find that it can dominate the market fairly easy if there are few other choices, or if it offers a different type of food than what can already be found nearby. For an online company, the story is quite different. Take for example online candle stores, a simple search in Google returns 12,700,000 hits for ‘online candle store.’ It should be fairly obvious that this does not mean there are that many online candle stores, but the likelihood that there are thousands, and even tens of thousands, of competitors in this space is fairly high. If not immediately scared off by the prospects of competing in this arena, a marketer must consider the options for setting itself apart from the competition.

Perhaps one of the best ways to rise above one’s competitors is to offer a new service in an established market. On very rare occasions, and available to only the most astute entrepreneurs, an opportunity presents itself to be the first, and thus the only, marketer using a promotional method to sell a product. One recent shining example of this is the company Timeless Candles. This company scored a first when it started a podcast and got it launched in to iTunes. The store had not even opened for business when it first began broadcasting as a way of attracting and educating customers. That move got it noticed by Paul Colligan who will feature the story in his soon to be published book ‘The Business Podcast Bible.’ In a blog posting Colligan wrote, ‘The angle that the Timeless Candles people are taking is an interesting one - building buzz for the site from the Podcast. Imagine hearing 9 episodes of something before you can even possibly visit the sales site.’ He shows his enthusiasm by finishing the post writing, ‘Personally, I think it?s brilliant.’

The Webmaster at Timeless Candles has also written in a blog about the company?s use of the podcast as a marketing tool, and he makes it clear that at its best the podcast is more than just another commercial, ?Although the end-game is obviously to have people buy candles from us, the podcast is really about creating a closer relationship with our? customers.? He goes on to write, ?? if the content is of value to them, they?ll not only stick with us for 9 episodes (and beyond), but Timeless Candles Podcast will become something they look forward to each week.?

The interesting lesson from a web site promotion perspective is how a company can take a newer, but existing technology, and use it to create a buzz for their product or service. This buzz will then lead to visitors and more links and ultimately greater search engine position.

Health and You

I have spent the last few days listening, listening to my feelings, listening to others but something still nags at me. I may have been listening, but nobody else was. I have been shown over and over again, that what is said is very different to what a person hears. Either a person is not interested, or maybe they have not been taught how to listen.

We live in a sick society, we are taught that as soon as you’re ill you have to visit your doctor, if you need to lose weight you have to go out and buy the latest ‘Scientific’ book on how to lose weight and change your life too. I’m sorry, but why do you need to spend money on a book/dvd on a subject that is so simple?

OK, before people start moaning that not all people who need to lose weight are able to. You are totally correct, there are a small number of people out there who have a medical condition that makes it very difficult to lose weight.

The sad fact of the matter is this, most people who are obese are totally unconscious of what they are shoveling into their mouths. If you confront these types of people, they will give you a hundred different reasons why they can’t. They are suffering from massive denial!

How many people still have no understanding of the human body that they inhabit, they abuse their bodies mentally and physically and then to add insult to injury they have no idea why it stops functioning. ?Quick phone the doctor, I am too lazy to do anything myself!?

Most illnesses has it’s roots in emotional problems, it is only when the emotional issue has not been dealt with that the body has to give you a huge kick in the butt. Nothing in this world happens without a reason, there are no ‘grey’ areas.

Are you going to get in touch with how you feel? Or do you need some ‘magic’ pills from the Doctors?

The big ‘Health & Fitness’ craze that has been around now for a number of years really makes me laugh, we are sold the benefit of joining a health club, sold a membership to run on a treadmill getting no where fast. We are sold the latest books, DVD’s and gadgets for getting super ripped abs. Spend $39.99 and in less than 20 minutes, 3 times per week you too can look like Cindy Crawford. Just don’t look in the mirror because you may realise you’re not Cindy and put that super gadget under the bed, next to the last gadget you brought.

Sorry if any of this is making you angry, but I get emotional when people refuse to take a long hard look at themselves. Yes I know that seeing yourself for who you are will be very painful, but don’t you think you owe it to yourself to be honest after all these years of neglect?

Throw away those silly gadgets that you never really wanted anyway, and stand tall as the creator of your universe.

Take a deep Breath and…………

Declare:

I am (Insert Name Here) and I am the creator of my universe, and I love myself for who I am.

40 Ways to Beat a DUI Arrest

Filed under: Legal — Donald Ramsell @ 3:38 pm

If you have been arrested for DUI or DWI, it is obviously cause for concern?but not for despair. By hiring a quality defense lawyer who can protect your rights, there are a host of ways your case may be defendable. That?s why it would be a good idea to consider hiring one of America?s Top DUI and DWI Defense Attorneys now. Here?s a few ways our lawyers may be able to win your case. Even if your case involves a drug, drugs, medicine or alcohol, they will help.

ILLEGAL STOP OF PERSON OR VEHICLE ? a driver cannot be stopped unless the officer has a reasonable and articulate basis to believe that a traffic law or other law has been violated. Similarly, a person cannot be seized unless a violation has occurred.

WEAVING INSIDE THE LANES IS NOT ILLEGAL ? weaving without crossing any lines is not a violation of the law, and a vehicle cannot be stopped for that reason.

ANONYMOUS REPORT OF DRUNK DRIVING ? a car cannot be stopped simply because an anonymous citizen reported that the driver was drunk.

STANDARD FIELD SOBRIETY TESTING IS INACCURATE ? in healthy individuals, the one-leg stand test is only 65% accurate, and the walk-and-turn test is only 68% accurate in determining if a person is under the influence. Those persons with injuries, medical conditions, 50 pounds or greater overweight, and 65 years or older cannot be validly judged by these tests.

NON-STANDARDIZED FIELD TESTS ARE INVALID ? neither the Federal Government (NHTSA) nor medical science considers touching your finger to your nose, or saying the alphabet, or counting backwards, as valid sobriety tests.

BREATH TESTING IS INACCURATE ? virtually all experts concede that one breath test alone is unreliable. Breath testing is subject to various inaccuracies, including a variance as much s +/- 12.5%, non-specificity for ethanol, etc.

BOOKING ROOM VIDEOS ? Many police stations videotape suspects at the police station, where their speech is clear and their balance is perfect, in spite of police testimony to the contrary.

IN-SQUAD VIDEOS ? more and more often, the suspect?s driving and performance on field tests is being recorded; often contradicting police testimony.

FAILURE TO PROVIDE SPEEDY TRIAL ? If a client is not provided with a trial within a certain period of time, which varies between states, through delays of the court or prosecutor, the charges must be dismissed.

POLICE BLOOD TEST INACCURATE ? Many times, police blood testing fails to follow prescribed rules of testing, analysis, or preservation recommendations.

HOSPITAL BLOOD TEST INACCURATE ? Hospital blood tests overestimate a person?s true level by as much as 25% in healthy, uninjured individuals, and are not statistically reliable in severely injured persons.

BREATH TEST OPERATOR UNLICENSED ? Most states require a Breath Test Operator to possess a valid, unexpired operator?s license, or the breath test result is inadmissible.

BREATHALYZER MACHINE MALFUNCTIONS ? Most states specify that if there is a malfunction or repair of the breath test instrument within a certain period of time before or after a suspect?s breath test, the results of the suspect?s test are presumed invalid.

BREATH TEST OPERATOR LICENSE EXPIRED ? Most states require that a Breath Test Operator must possess an unexpired operator?s license, or the breath test result is inadmissible.

BREATH TEST DEVICE NOT APPROVED ? A breath-testing instrument must be listed on the Federal List of Approved Breath Evidential Instruments and the ISP approved list of Devices, or the results are inadmissible.

FAILURE TO PROVE DRIVING UNDER THE INFLUENCE ? A defendant?s admission to driving, without more, does not prove a charge of driving under the influence.

INDEPENDENT WITNESSES ? Often times, independent witnesses to accidents, bartenders, hospital personnel and others can provide crucial evidence of the defendant?s sobriety.

FAILURE TO MIRANDIZE ? Prosecutors may not use as evidence the statements of a defendant in custody for a DUI when the police have failed to properly issue Miranda Warnings.

FIELD SOBRIETY TEST IMPROPERLY ADMINISTERED ? According to the National Highway and Traffic Safety Administration, improperly administered field tests are not valid evidence of intoxication.

OFFICER?S PRIOR DISCIPLINARY RECORD ? A police officer?s previous disciplinary record can be used to attack the officer?s credibility.

PORTABLE BREATH TEST INADMISSIBLE ? Most states prohibit the use of portable breath testing results as evidence at trial in a DUI case.

PORTABLE BREATH TEST IMPROPERLY ADMINISTERED ? The manufacturers of portable breath testing devices require a minimum of two tests to consider the results evidential in nature.

FAILURE TO CONDUCT OBSERVATION PERIOD ? Most states require that a driver be observed continuously for a minimum period, such as twenty minutes, prior to a breath test in order for the results to be considered admissible and valid.

EXPERT WITNESSES ? Expert witnesses are available to review the validity of breath tests, blood tests and field sobriety tests.

MEDICAL AND HEALTH PROBLEMS ? Medical problems with legs, arms, neck, back and eyes can affect the results of field sobriety tests. Further, other medical conditions can also affect the validity of breath test results.

BAD WEATHER ? Weather reports establishing high winds, low visibility, and other conditions are available to explain poor driving or poor balance.

LACK OF PROBABLE CAUSE TO ARREST ? A police officer must have specific and articulable facts to support any arrest for DUI, or the suspension will be reversed and the evidence suppressed at trial.

ILLEGAL SEARCH ? The police are prohibited from searching a person or the automobile for a minor traffic offense, and may not search a car without a driver?s consent or probable cause. Any evidence illegally obtained is not admissible in court.

PRIOR INCONSISTENT STATEMENTS BY POLICE OFFICERS ? Any statement made by a police officer, verbally, in police reports, or at previous court proceedings may be used to attack that officer?s credibility.

POST-DRIVING ABSORPTION OF ALCOHOL ? The prosecutor must prove the blood or breath alcohol at the time of driving. Recent consumption of alcohol just prior to driving will cause the test results to be higher than what the true level was when the person was operating the automobile.

INTERFERING SUBSTANCES ? Many items contain forms of alcohol, which may cause false results, such as asthma spray, cough drops, paints, fingernail polish. These items can cause the breath results to be invalid.

BREATH MACHINE NOT PROPERLY OPERATED ? The manufacturers of breath testing devices have specified protocols, which must be followed for a breath result to be valid. Failure to follow these requirements will result in improper readings.

FAILURES TO PRODUCE DISPATCH TAPES ? Most stops of vehicles are recorded on dispatch tapes, as well as recording police communications regarding an arrest of an individual. Failure to preserve such tapes upon request can cause all evidence, which could have been recorded to be suppressed.

MISLEADING STATEMENTS BY POLICE OFFICERS ? Any misleading statement by the police regarding the consequences of taking (or refusing) a blood, breath, or urine test will cause the suspension to be reversed and removed from the driver?s record.

STATUTES OF LIMITATIONS ? A misdemeanor charge of DUI must be filed within a certain period of time (which varies between states) of the date of offense, or the charges will be dismissed outright.

PRIVATE PROPERTY ? A person who has not driven the car on a public highway cannot be suspended for drunk driving.

FAILURE TO DISCLOSE EXPERTS ? The failure of the prosecutor to disclose the state?s expert(s) will cause those witnesses to be barred from testifying against the defendant.

LACTATE RINGERS ? When hospital staff use lactate ringers during the treatment of a patient, the hospital blood serum results will report falsely elevated, and therefore invalid, readings.

FAILURE TO RECORD CERTIFICATION TESTS ? the failure to include the value of the simulator solution used to test breath machines will cause the breath test results to be inadmissible in court against the driver.

FORCED BLOOD DRAWS ? In some states, the police may not take a blood test against the driver?s consent where there has not been an injury involved, or the result is inadmissible.

Vegetables - Health Food Or Killers

With the recent outbreak of e-coli traced back to bagged spinach of all things, the FDA now suggests consumers thoroughly wash all bagged produce (including salad) before consuming it to avoid the extreme diarrhea e-coli bacterial can cause.

The e-coli bacteria can be found in any raw or undercooked foods. Most often outbreaks are linked to undercooked meat, or unsafe handling of raw meat, particularly ground beef. What was up until now less well known is that e-coli can also be found on fresh produce like fruits and vegetables.

E-coli bacteria cause severe diarrhea often with bloody stool and can cause kidney failure and possible death. The old and the young are particularly prone to extreme cases of the infection. If you suspect you have been infected with e-coli, contact your physician right away.

E-coli naturally occurs in the intestines of animals like cows and chickens. As these animals are slaughtered and processed, traces of the bacteria can come into contact with the meat. Ground beef seems to be especially prone to getting contaminated. To kill any e-coli (or other bacteria for that matter) that may have ?snuck in?, cook all meat to an internal temperature of at least 160 F.

So, how does this same bacteria get into our salad, veggies and fruit? Manure is often used as a natural fertilizer and gets? stuck on the outside of the vegetables and fruits as they grow and are harvested. Produce is cleaned off before it?s bagged and shipped to you, but that doesn?t necessarily mean all the bacteria are gone.

In particular vegetables including salad that are bagged provide a perfect growing environment for the e-coli bacteria. The bag ensures that there is always some moisture around the produce that allows the e-coli to multiply.

The recent outbreak of e-coli in bagged spinach along with previous outbreaks in bagged salad mixes and even containers of strawberries makes you wonder if we should just avoid all prepackaged and bagged produce. Fortunately we don?t have to go that far, but we should get in the habit of properly preparing those foods.

Salad and vegetables mixes in bags are often pre-washed and sold as ?ready to serve?. Take a few minutes and rinse them with warm water, followed by a splash of cold water to avoid cooking the spinach or salad. Use plenty of warm water on hardier vegetables such as tomatoes or carrots and don?t forget to wash fruit with plenty of water as well, especially strawberries. Strawberries grow very low to the ground and are often fertilized with manure or are grown on soil that was previously fertilized that way. Since the berries grow practically directly on top of the soil, it is easy for the e-coli to catch a ride on the fruit directly into your home.

Washing raw fruit and vegetables with plenty of warm water should get rid of most of the bacteria, making it safe to eat. Make it a habit to wash your produce whether the packaging indicates it?s pre-washed or not. It will only take a few minutes and could prevent you from getting sick in the long run.
